AGREEMENT, RELEASE FROM LIABILITY, WAIVER OF CLAIMS & ASSUMPTION OF RISK

I agree to pay all participation fees. I, on behalf of myself, my heirs, executors, agents, assigns, and representatives, hereby indemnify, release and forever hold harmless Murphy Music Makers LLC, as well as its directors, employees and instructors, from any and all claims of liability arising from any accident, personal injury, death, or property loss or damage sustained by my child/myself/the minor child for whom I am a legal guardian, while that person is participating in activities connected with Murphy Music Makers LLC, including classes, rehearsals, performances, or other activities. I understand that dance activities have inherent risks of injury, and, being fully aware of all risk, I consent to have my child/myself/the minor child for whom I am a legal guardian, participate in the programs and activities offered by Murphy Music Makers LLC and I accept full responsibility for providing adequate health and accident insurance coverage for the protection of all of the following who participate in these programs/activities: my child/myself/the minor child for whom I am a legal guardian. By signing this statement, I declare that the aforesaid participant is in good health, with no physical conditions that might prevent his/her/my participation in strenuous and rigorous dance activities and other training and performance connected with musical theater. Further I understand and acknowledge that because of the physical nature of theater, there may be physical contact between directors, employees, staff, company members, instructors and students during rehearsals, shows, workshops, productions, and especially during vocal, dance or acting instruction. I understand that at times for proper instruction and safety, physical contact is required and necessary. Also, I hereby give permission, in the event of an accident or medical emergency, to Murphy Music Makers LLC and/or appropriate emergency medical and hospital staff to provide necessary first aid and medical treatment to my child in my absence including transportation to a medical facility. I have carefully read this Agreement, Waiver, Release, & Assumption of Risk and fully understand its contents. I understand that this is an assumption of risk and release of liability, and I sign it of my own free will.

COVID-19

I acknowledge the contagious nature of COVID-19 and other contagious diseases and viruses and voluntarily assume the risk that I and/or my children may be exposed to or infected by COVID-19 by attending and participating and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand the risk of becoming exposed to or infected by COVID-19 and other contagious diseases and viruses may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, contractors, volunteers, and program participants and their families. It is my express intent that this Hold Harmless Agreement shall be deemed as a release, waiver, discharge, and covenant not to sue Murphy Music Makers LLC including but not limited to its owners, agents, employees, representatives and volunteers. It is my express intent that this Hold Harmless Agreement shall be deemed as a release, waiver, discharge, and covenant not to sue any Program and Event locations. The undersigned parent/guardian will agree to defend, hold harmless, and indemnify Murphy Music Makers LLC from any cost, loss, or damages of any type, including attorney fees, to the extent that they arise from the contracting of COVID-19 and any related illnesses and costs or expenses

CONDUCT

Murphy Music Makers LLC has the authority to establish the rules necessary for the operation of the Programs or Events and has the sole discretion to decide that an individual should be separated from the Programs or Events because of a violation of such rules, for disruptive behavior, for conduct which could bring the Programs or Events and/or the Organization or its members into disrepute, or for conduct which violates any policy or procedure of the organization. The decision to separate the individual shall be final. I understand that if I am required to leave the Programs or Events, no refund will be made.

LATE PICK-UP

I understand that if I or an authorized pickup person are late, I will be billed a late fee of $15.00 for each fifteen minute increment or any portion thereof.

ACKNOWLEDGEMENTS

In signing this Agreement, I acknowledge and represent that I have fully informed myself of the content of the foregoing Waiver of Liability and Hold Harmless Agreement by reading it before I sign it, and understand that I sign this document as my own free act and deed; no oral representations, statement, or inducements, apart from the foregoing written statement, have been made. I further state that I am at least eighteen (18) years of age and fully competent to sign this agreement; and that I execute this Agreement for full, adequate, and complete consideration fully intending to be bound by the same.

COMMUNICATION

Our main form of communication regarding our classes is via email. Text messages may be utilized in addition to emails, on an opt-in basis. We do not release any personal information to third parties. Your family can opt out of receiving emails, but risk missing information regarding the classes, material, and cancellations.

MISSED CLASSES

Refunds will be not be given for any missed classes.
